CRM (NDPS) 1678 of 2026

In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Special Case No. 87 of 2025 (N), arising out of STF HQ Police Station case no. 11 of 2025 dated 18.11.2025 under Sections 20(b)(ii)(C)/25/29 of the NDPS Act.

And In the matter of : Md. Samsul Rahaman

……Petitioner. Mr. Kallol Mondal, Ld. PP Mr. Anamitra Banerjee Ms. Nabanita Chatterjee

……for the State.

Petitioner is the driver of a vehicle from where there has been alleged recovery of 677.24 kgs of ganja. Record reflects that there were earlier rejection of bail so far as the other accused persons are concerned. One of the accused approached the Hon’ble Supreme Court in Special Leave to Appeal (Crl.) 14409 of 2026, the prayer for bail was rejected with a direction that the trial be progressed within a period of one year from the date of framing of charges. Having considered the directions passed by the Hon’ble Supreme Court, I am of the opinion that there has been no new change of circumstances. Accordingly, the prayer for bail of the petitioner in CRM (NDPS) 1678 of 2026 is dismissed. The order in respect rejection of bail order of Sanjiban Biswas in CRM (NDPS) 1863 of 2026 be kept with the record.

2 All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
