In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Gaighata Police Station case no. 343 of 2026 dated 20.04.2026 under Sections 329(4)/115(2)/117(2)/110/351(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023.
And In the matter of : Pankaj Shil
……Petitioner. Ms. Aiswarjya Gupta Ms. Priyanka Saha
.....for the Petitioner. Mr. Sandipan Pal Mr. Niladri Mondal
.....for the De-facto complainant. Ms. Soma Mishra Chatterjee Ms. Sharmishta Dey
……for the State.
Learned advocate appearing for the petitioner submits that petitioner has been foisted with the criminal case because of earlier criminal case initiated at the behest of the wife of the present petitioner. Learned advocate appearing for the State produces the Case Diary and draws the attention to the injury reports. I have taken into account the injury suffered particularly, at the eyes. However, learned advocate appearing for the de-facto complainant do not oppose the prayer for anticipatory bail. Be that as it may, having considered the circumstances under which the incident took place, I am of the opinion that this is not a fit case for granting anticipatory bail.
2 Accordingly, CRM (A) 2811 of 2026 is dismissed. However, if the petitioner appears before the jurisdictional Court and the de-facto complainant has no objection, learned trial Court would consider the change circumstances and deal with the application for bail independently. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
