CRM (M) 1814 of 2026

In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Narendrapur PS Case No. 914/2024 dated 30.07.2024 u/s 376 of the IPC read with section 6 of the POCSO Act.

-And-

In the matter of : Sohan Mondal @ Sohan Ali Mondal

… Petitioner(s)

Mr. Sumen De

… for the Petitioner(s)

Mr. Somnath Bera

… for the State-respondent(s) Mr. R. V. Kundalia

… for the defacto-complainant

Learned advocate for the petitioner submits that the petitioner is in custody for more than two years and there was a relationship between the present petitioner and the victim, as such, since there is no possibility of the trial being concluded very soon, the petitioner may be released on bail. Learned advocate for the defacto-complainant opposes the prayer for bail and submits that at the relevant point of time, the victim was carrying for 28 weeks. State also opposes the prayer for bail and draws the attention of the court to the statement of the victim under section 183 of the BNSS.

2 I have taken into account the present stage of the case and the complicity of the present petitioner as also the fact that the evidence of the victim is in progress. Having regard to the same, I am of the considered opinion that this is not a fit case for granting bail to the present petitioner. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (M) 1814 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
