15.09.2026 Court No.35. D/L.195. Rakib (Rejected)

CRM (A) 2807 of 2026

In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Sagar Dighi Police Station case no. 174 of 2024 dated 30.04.2024 under Sections 20(b)(ii)(C)/29 of the NDPS Act.

And In the matter of : Bikash Sardar

……Petitioner. Ms. Soumili Paul

.....for the Petitioner. Mr. Priyankar Ganguly Ms. Shalini Bairagi

……for the State.

Learned advocate appearing for the petitioner submits that petitioner is innocent and has been falsely implicated in connection with the instant case. Learned advocate appearing for the State has opposed the prayer for anticipatory bail and submitted that the total recovery in the present case is 323.14 kgs of ganja. It has been reflected from the Case Diary that there are Call Data Records, although, there are no recovery from the present petitioner. Having considered the case is for anticipatory bail and CDR are available, I am of the opinion that this is not a fit case for granting anticipatory bail. Accordingly, CRM (A) 2807 of 2026 is dismissed.
