CRM (M) 2035 of 2026

In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Magrahat Police Station case no. 98 of 2021 dated 12.04.2021 under Sections 341/323/506/376DA of the Indian Penal Code and Section 6 of the POCSO Act, 2012.

And In the matter of : Farman Sardar @ Farman Molla

……Petitioner. Mr. Deepak Prahladka Ms. Reshmi Khatun

.....for the Petitioner. Mr. Prithish Bandhopadhyay Mr. Apan Saha Mr. Bubai Sardar Ms. Tasnim Ahmed

......for the De-facto complainant. Mr. Kousik Dey Mr. Kuntal Ray

……for the State.

Learned advocate appearing for the petitioner submits that petitioner is similarly situated as other accused person who has been granted bail in CRM (M) 1466 of 2026. Learned advocate appearing for the de-facto complainant opposes the prayer for bail. State has raised objection. Having considered that the petitioner is in custody for five years five months, I am inclined to release the petitioner on bail on same terms and conditions as was imposed to the other accused person in CRM (M) 1466 of 2026. As such, prayer for bail of the petitioner namely, Farman Sardar @ Farman Molla is allowed.

2 With the aforesaid observations, CRM (M) No. 2035 of 2026 is allowed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
