1. The learned advocate for the Respondents cites a judgment dated 24th February, 2026, delivered by the Hon’ble Supreme Court in a group of cases in Civil Appeal No. 4432 of 2019 (Union of India & Ors. vs. E Sreeramulu & Ors.), by which the issue raised in this Petition was adjudicated upon and the judgment is delivered against the Union of India.

2. Learned counsel for the Union of India confirms that such a judgment is delivered in E Sreeramulu and connected matters and the view of the Hon’ble Supreme

Court, is against the Union of India. He fairly submits that the present Petition is governed by the said judgment.

3. In view of the above, since the Hon’ble Supreme Court has crystallised the law, this Petition is dismissed. Pending Applications are also dismissed. (Tapabrata Chakraborty, J.) (Ravindra V. Ghuge ) Chief Justice
