1. Learned Advocate for the petitioner submits that the victim committed suicide following a dispute that arose between the principal accused and the victim. The principal accused and other family members of the victim are on bail. He submits that the petitioner has been falsely implicated in the instant case. He prays for bail.

2. Learned Advocate for the State produces the case diary, memo of evidence and opposes the prayer for anticipatory bail.

3. Heard the learned Advocates appearing for the respective parties and perused the materials in the case diary, including the post- mortem report. The post-mortem report shows a non-continuous ligature mark on the neck of the victim, which prima facie suggests that the victim committed suicide. Charge-sheet has been submitted under Sections 85 and 108 of the BNSS. The principal accused and other family members of the victim are on bail. Noting these facts and considering the materials on record and the role attributed to the petitioner, I am of the view that

2 custodial interrogation of the petitioner is not necessary and that the privilege under Section 482 of the BNSS can be extended in favour of the petitioner.

4. Accordingly, I direct that, in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs. 10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, to the satisfaction of the learned ACJM Gangarampur at Buniadpur, Dakshin Dinajpur and also subject to the conditions as laid down under Section 482(2) of the BNSS, 2023.

5. The application being CRM (A) 2357 of 2026 is disposed of.
