IA No.: CAN 1 of 2026 [Restoration] Praveen Kumar Thakur
– Versus – The Union of India & Others in WPCT 206 of 2025
Mr. Surajit Samanta, Ms. Sohini Samanta, Mr. Roop Shankar Roy, Mr. Subhasis Maity … for the Applicant/Petitioner. Ms. Sipra Chanda … for the Respondents. Upon hearing the learned advocates appearing for the respective parties and considering the materials on record, we are satisfied with the explanation given towards the absence of the learned advocate-on-record of the petitioner before the Court on 27th August, 2026 when the writ petition was dismissed for default. Accordingly, the order dated 27th August, 2026 is recalled and the restoration application is allowed. The writ petition, being WPCT 206 of 2025 is restored to its original file and number. The restoration application, being IA No.: CAN 1 of 2026 is, thus, disposed of. WPCT 206 of 2025 Upon hearing the learned advocates appearing for the respective parties and considering the materials on record, we are of the opinion that there is no scope towards issuance of any interim order. However, the writ petition needs to be heard finally.
We have been informed that all the pleadings and documents exchanged by the parties before the learned Tribunal have already been annexed to the present writ petition. In view thereof, list the writ petition for final hearing in the combined monthly list of November, 2026. (Atarup Banerjee, J.) (Tapabrata Chakraborty, A.C.J.) 2
