SUKUMAR BAIDYA VS AYAN DUTTA GUPTA

Mr. Prabir Maji … for the Applicant.

Ms. Susmita Saha Dutta Mr. Niladri Saha ….for the alleged contemnor.

The alleged contemnor is present in court. Admittedly, the alleged contemnor has passed an order of demolition. The persons aggrieved by the said order have preferred a statutory appeal. Under such circumstances, nothing remains to be decided in the contempt application. Accordingly, the contempt proceedings are dropped and the contempt application is disposed of. The Rule is discharged. The applicant will be at liberty to take steps as may be available in law once the appeal is disposed of. It is expected that the appeal shall be disposed of expeditiously and adequate steps shall be taken, strictly in accordance with law.
