06.08.2026 Item No.36 Court No.01 Avijit Mitra

WPA (P) 365 of 2026 Sukhendu Sarkar

- Versus – The State of West Bengal & ors. Mr. Sabyasachi Chatterjee, Mr. Kiron Sk. ….for the petitioner Mr. Surajit Nath Mitra, Ld. Advocate General, Mr. Billwadal Bhattacharyya, Ld. A.A.G., Mr. Rajdeep Mazumder, Ld. A.A.G., Mr. Srijib Chakraborty, Mr. Rajdeep Mantha, Mr. Sourav Sengupta ....for the State The present Public Interest Litigation has been preferred challenging inter alia, the validity of the West Bengal Public Safety and Control of Anti-Social Activities Act, 2026 (in short, the said Act of 2026). Heard Mr. Chatterjee, learned advocate appearing for the petitioner. Mr. Mitra, learned Advocate General appearing for the State submits, upon instruction, that the said Act of 2026 is yet to receive the President’s assent. In view thereof, in our opinion, the present Public Interest Litigation is a premature one and is, accordingly, dismissed. Needless to observe, once the said Act receives the President’s assent, the petitioner may approach this Court, if so advised and in accordance with law. (Partha Sarathi Chatterjee, J.) (Tapabrata Chakraborty, A.C.J.)
