In the matter of : Jamal Huque &Anr.

… Petitioner(s)

Ms. Madhushri Dutta Ms. Arpita Das

… for the Petitioner(s) Mr. Avrojyoti Das, APP Mr. Bapi Sarkar

… for the State-respondent(s)

Learned advocate for the petitioners submits that the petitioners have been foisted with the present criminal case only on the basis of statement of a co-accused, although the recovery in the present case is 26 gm of brown sugar from another accused who was in custody and subsequently released on bail. State opposes the prayer for anticipatory bail but is unable to rebut the contention that the petitioners have been implicated in the present case on the foundation of the statement of a co-accused.

It has been further submitted on behalf of the State that there are no CDR and/or money trail so far as the present petitioners are concerned. Having considered the above, I am inclined to grant anticipatory bail to the present petitioners. Hence, the prayer for bail of the petitioners is Allowed.

Accordingly, I direct that in the event of arrest, the petitioners [Jamal Huque and Ayub Ali] be released on anticipatory bail subject to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

As charge-sheet has been submitted, this order of anticipatory bail will remain valid for a period of six weeks from date. Accordingly, CRM (A) 819 of 2026 is allowed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
