IN THE HIGH COURT AT CALCUTTA CIRCUIT BENCH AT JALPAIGURI CONSTITUTIONAL WRIT JURISDICTION 08.10.2026 rc/ct.no.CB-06 Item No.42 WPA No. 1997 of 2026 Mase Social Welfare Division Versus The State of West Bengal & Ors.

Adv. Mir Anowar Adv. Subinay Dey Adv. Debanjan Das Adv. Sukanya Bhaumik Adv. Supriya Roy …for the petitioner

Adv. Supriya Singh Adv. Bibek Tarafdar … for the State

Affidavit of service and supplementary affidavit submitted by the petitioner are taken on record. It appears that the service made upon the private respondents has returned with an endorsement ‘rerfused’ which amounts to good service. The private respondents are not represented despite service. Learned counsel for the petitioner submits that the petitioner is a society involved in several activities for creating infrastructure for the benefit of the local people and other benevolent work and purchased about 25 decimals of land in the Dag No. 302 in mouza Kharija Balakura in Cooch Behar in 2008. Some property was also gifted to the petitioner by the well wishers. The petitioner alleges that the private respondents forcibly entered the property, tried to take possession of the same, damaged the computers, books and other material therein and man-handled the petitioner and other members of the society for which the petitioner lodged a complaint before the jurisdictional police authority against them. During pendency of the writ petition, the complaint has been registered as Dinhata Police Station Case No. 627 of 2026 dated September 03, 2026. The petitioner seeks a direction upon the police authority to protect the property and life of the petitioner and other members. Learned counsel for the State submits that pursuant to the complaint lodged by the petitioner, a specific case has been registered and investigation is in progress. In view of the above, the Inspector in Charge, Dinhata Police Station, being the 5th respondent herein, is directed to take necessary steps for proper investigation of the complaint lodged by the petitioner and maintain vigil in the locality in order to ensure peace and tranquility therein and to prevent breach of land and order. On the prayer of the petitioner, liberty is granted to submit an appropriate application before the Superintendent of Police, Coochbehar seeking necessary police assistance/protection in the plot in question at the cost of the petitioner. In the event such application is filed, the Superintendent of Police, Coochbehar shall consider the situation as well as requirement for the same and take necessary steps, in accordance with law. The writ petition is disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh,J)
