(50) ARDR In the High Court at Calcutta Circuit Bench at Jalpaiguri Constitutional Writ Jurisdiction

WPA 2249 of 2026

Darjeeling Dreams Vs. The Union of India & ors.

Adv. Hillol Saha Poddar, … for the petitioner. Adv. Milindo Paul, Adv. Nabankur Paul, Adv. Subham Das, Adv. Bedashruti Bose, …for the respondent nos. 3 & 4. Adv. Kunaljit Bhattacharjee, Adv. Bibek Tarafder, …for the State.

Learned counsel for the petitioner submits that the petitioner’s current account no.924020037093470 with the AXIS bank, Sevak Roaad Branch, Siliguri has been frozen on the ground of suspicious transaction in the said account. The petitioner seeks defreezing of the said account upon holding the disputed amount in the said account on lien. Learned counsel for the State submits, on instruction, that Garfa Police Station has sent instruction to the effect that during course of enquiry/investigation, no e-mail was found to have been sent from the official e-mail ID of Garfa Police Station or the Cyber Cell, South Subarban Division directing freezing of or issuing any notice for freezing the relevant bank account. An e-mail was sent from the official e-mail ID of the Cyber Cell, South Subarban Division to the official e-mail ID of the Nodal Officer of the AXIS Bank on 21st September, 2026 instructing to defreeze the aforesaid bank account by keeping the disputed amount of Rs.1,000/- under lien. No other instruction is received from the other police stations. Learned counsel appearing for the Bank submits the copies of complaints received by the bank demonstrating the disputed amount. The complaints indicate suspicious transaction of certain amount in the relevant bank account. The petitioner submits that freezing of the entire account is adversely affecting his interest and he may be allowed to operate the account upon freezing the disputed account. There is substance in the contention of the petitioner. Freezing of the account as a whole may not be required for the purpose of investigation with regard to the suspicious transaction therein pertaining to a certain amount. In view of the above, the Branch Manager, AXIS Bank, Sevak Road, Siliguri, being the 4th respondent herein, is directed to defreeze the relevant current account of the petitioner upon holding the disputed amount lying therein on lien. With the aforesaid direction, the writ petition is disposed of. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J)
