1. The application for anticipatory bail is canvassed on the ground that the victim has filed the complaint as a counter blast to an earlier complaint lodged by the applicant against her that is registered as FIR No. 192 of 2026 dated 27th May, 2026.

2. It appears that the incident in which the petitioner/applicant and her husband have been named, occurred on 22nd of May, 2026 and a complaint was lodged by the victim on 25th May, 2026 before the complaint of the applicant to the Kharibari Police Station. It therefore cannot be held that the complaint is a counter blast to any prior proceeding taken out by the applicant against the victm.

3. It further appears that the applicant has photographed the victim in course of sexual assault committed by her husband.

4. In the light of the above, this Court is not inclined to grant anticipatory bail to the applicant/petitioner.

5. The application for anticipatory bail, being CRM (A) 765 of 2026 is rejected at this stage.

6. Report of the Kharibari Police Station dated 29.09.2026 is kept with the record.

7. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
