1. The application for anticipatory bail is canvassed on the ground that the disputes between the petitioner and the de facto complainant are primarily civil in nature.

2. Learned counsel for the de facto complainant submits that the deposits slips under which the consideration paid by his client for purchase of immovable property from the applicants has been forged to indicate that the de facto complainant has voluntarily accepted return of the purchase price.

3. According to the learned counsel for the de facto complainant, his clients have never agreed to seek return of the purchase price and are still interested in purchasing the immovable property.

4. This Court notices that the disputes have primarily a civil flavour. The allegation of forgery by the de facto complainant against the petitioners can be investigated even without custodial interrogation.

5. In the light of the above, this Court is of the view that the applicants are entitled to anticipatory bail.

6. Accordingly, I direct that in the event of arrest the petitioners/applicants shall be released on bail upon furnishing a bond of Rs.50,000/- each with two sureties of like amount each, one of whom must be local to the satisfaction of the ACJM, Siliguri and subject to the conditions that they shall attend the I.O. as and when summoned and cooperate with the investigation. The further condition is that the petitioners shall surrender their mobile numbers and provide their present addresses to the concerned I.O.

7. In the event the conditions are violated, the anticipatory bail will stand automatically cancelled.

8. The application for anticipatory bail, being CRM (A) 725 of 2026 is allowed and disposed of.

9. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
