WPA 2142 of 2026

Aparna Maurya Vs. The Joint Commissioner of Customs (Preventive), Kolkata & ors.

Adv. Arnab Chakraborty (VC), Adv. Abhilash Mittal, Adv. Hiqa Naz Pradhan, … for the petitioner. Adv. Ratan Banik, Adv. Bishwarj Agarwal, … for the State.

Affidavit of service filed by the petitioner is taken on record. The petitioner seeks provisional release of the goods seized by the customs officials in connection with Unit case dated 11th August, 2026. The petitioner submitted a representation in this regard before the concerned authority on 12th August, 2026 and seeks expeditious consideration of the same. The petitioner also seeks a direction upon the authority to furnish the documents relied upon by them prior to consideration of the representation. Learned counsel for the customs authority submits that the goods have been seized in terms of Section 110 of the Customs Act, 1962 and relied upon documents shall be disclosed to the petitioner at the appropriate stage of adjudication.

2 In view of the fact that the application submitted by the petitioner for provisional release of the goods is pending since 12th August, 2026, the Joint Commissioner of Customs (Preventive), Kolkata, being the 1st respondent herein, is directed to consider and dispose of the same within six weeks from the date of communication of this order upon granting reasonable opportunity of hearing to the petitioner, in accordance with law. The decision taken by the authority shall be communicated to the petitioner within a week thereof. In the event the authority arrives at a decision in favour of the petitioner, necessary consequential steps be taken at the earliest. The writ petition is disposed of accordingly. However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J)
