CRM (NDPS) 572 of 2026
In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Pradhannagar Police Station case no. 625 of 2025 dated 12.09.2025 under Sections 21(c)/22(c) of the NDPS Act.
And In the matter of : Md. Najrul Islam @ Nazrul Islam & Anr.
……Petitioners. Mr. Subhadip Dhara
......for the Petitioners. Mr. Avrojyoti Das, Ld. APP Mr. Gobinda Ghosh Mr. Tapash Prasad
……for the State.
Learned advocate appearing for the petitioners submit that there has been alleged recovery of brown sugar from the petitioners and they have been detained for 370 days. Charge-sheet has been submitted and there is no possibility of the trial being to its logical conclusion. As such, petitioner be released on bail on any stringent conditions. Learned advocate appearing for the State has vehemently opposed the prayer for bail and submits that there was recovery of 587 grams of brown sugar from petitioner no.2 and 542 grams of brown sugar from the petitioner no.1, aggregating to a sum of 1129 grams of brown sugar.
2 Having considered the quantum of seizure in the present case, I am of the opinion that the rigors of Section 37 of NDPS Act is attracted. As such prayer for bail of the petitioner in CRM (NDPS) 572 of 2026 is rejected. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
