18.09.2026 Court No.35. D/L.01. Rakib (Rejected) In the High Court at Calcutta Circuit Bench at Jalpaiguri Criminal Miscellaneous Jurisdiction
CRM (NDPS) 567 of 2026
In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Matigara Police Station case no. 567 of 2025 dated 08.085.2025 under Sections 21(c) of the NDPS Act.
And In the matter of : Ananda Biswas
……Petitioner. Mr. Navanil De Mr. Srinjan Ghosh Ms. Rishita Chakraborty Mr. Naser Ali
......for the Petitioner. Mr. Avrojyoti Das, Ld. APP Mr. Bijay Bikram Das Mr. Abhilash Mittal
……for the State.
Learned advocate appearing for the petitioner submits that petitioner is in custody for about 13 months, charge-sheet has been submitted and prosecution has relied upon 16 witnesses in order to prove its case. As such, there is no possibility of the trial being taken to its logical conclusion, petitioner may be released on bail on stringent conditions. Learned advocate appearing for the State opposes the prayer for bail and submits that the quantum of seizure is of commercial quantity. I have taken into account the quantum of seizure wherein rigors of Section 37 of the NDPS Act is attracted.
2 Petitioner will renew his prayer for bail after the evidence of the seizure list witnesses are over. Learned trial Court would give priority to the seizure list witnesses and complete the said witnesses preferably within a period of one month from the next date fixed. With the aforesaid observations, CRM (NDPS) 567 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
