1. Learned advocate representing the opposite has filed the certified copy of the order dated July 10, 2026, which reflects that the ACT VIII Case No.10 of 2024 stands dismissed for default. The instant application was filed challenging the order dated October 5, 2024 passed by the learned District Judge, Darjeeling in ACT VIII Case No.10 of 2024.
2. It is submitted by the learned advocate of the opposite party that this revisional application has become influctuous in view of the above development.
3. The learned advocate representing the petitioner fairly submits that he has no instruction in this regard.

4. In view of the above, the original proceeding is no more in existence and hence the application pending before this Court has become influctuous.
5. Hence this revisional application stands disposed of being infructuous.
