1. Learned counsel for the petitioner has submitted that the petitioner is in custody for more than 493 days. There is no chance of early conclusion of the trial since the charge has not been framed.
2. Considering the period of detention, the petitioner may be enlarged on bail on any condition.
3. Learned counsel for the State opposes the prayer for bail. According to him, there is sufficient reason for not framing of charge by the learned Trial Court since one of the accused still remained absconded. Subsequently, the said accused filed an anticipatory bail before this Hon’ble Court but the same was rejected.
4. I have gone through the materials on record. It appears that the commercial quantities of contraband article were recovered from the possession of the present petitioner and others. There is sufficient reason for not framing of charges by the learned Trial Court since one of the accused at the relevant point of time remained absconded.
5. The petitioner has not been able to tide over the restrictions imposed under Section 37 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
6. The bail application being CRM (NDPS) 421 of 2026 is dismissed.
7. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
8. Criminal Section is directed to supply certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities.
