CALCUTTA HIGH COURT IN THE CIRCUIT BENCH AT JALPAIGURI

CRM (A) No. 570 of 2026

In Re: - An application for anticipatory bail under section 438 of the Code of Criminal Procedure, 1973/Section 482 of the B.N.S.S. 2023, in connection with Matigara Police Station Case No.272 of 2023, dated 08.04.2023 under Sections 341/ 354/ 354B/ 307/324/509/506/34 of the IPC, 1860. And

In the matter of: Lalan Jha & Anr. ….Petitioners.

Mr. Hillol Saha Podder Ms. Mousumi Das …for the Petitioners.

Mr. Janardan Periwal Mr. Sanjay Mazoomdar Mr. Tapas Prasad ….for the State.

The petitioners pray for pre-arrest bail on the ground that the petitioners are the in-laws and have been falsely implicated. It is submitted that the investigation is complete and hence custodial interrogation is not required. Learned advocate for the State opposes prayer for grant of pre- arrest bail. Considered the injury report, the role ascribed to the petitioners, the contents of the complaint and the medical report. The application for anticipatory bail is, thus, dismissed. As the investigation is over, the petitioners are at liberty to approach the learned jurisdictional court and pray for regular bail.
