1. Heard learned advocates for the parties.
2. The writ petition has been filed with a claim that the petitioner should be given a permission to utilize the footpath next to the National Highway No.4 for organizing Mela. It is submitted that in this regard NHIDCL has also given “No Objection Certificate”.
3. Learned advocate for the NHIDCL, however, appeared virtually and submitted that the alleged No Objection Certificate dated 18.09.2026 is nothing more than a communication given to the Administrative Authority regarding to the terms and conditions subject to which utilization of any area near the National Highway for holding “Mela” in connection with the Durga Puja can be undertaken by any authorities.
4. There is no existing NOC for grant of permission as claimed by the writ petitioner, in the communication dated 18.09.2026. This Court finds force in such submission from the bare perusal of the letter dated 18.09.2026. No enforceable right is made out for issuance of any direction based on communication of the NHIDCL dated 18.09.2026.
5. This Court therefore leave it to the authorities to consider the petitioner’s claim in accordance with law.
6. The writ petition is accordingly dismissed.
7. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
