1. The supplementary affidavit has been filed by the respondent no.2 based on the records maintained in the office of the respondents. It is submitted that he does not wish to press the averments made in paragraphs 5, 6 and 9 of the affidavit-in-opposition.
2. The supplementary affidavit was filed since averments were made in the affidavit-in-opposition that the petitioner did not supply a valid, correctly formatted, and verified affidavit, as well as necessary identity documents (Aadhaar Card) required for providing electrical connection on the encroached lands. Similar averments made as regards the other regulatory requirements.
3. Learned counsel for the petitioner submitted that the petitioner would ensure compliance with requisites in terms of Clause 5.30, (7) and (8) of the Supply Code, 2018.
4. Considering the rival submissions, since the parties are ad idem on the issue that the compliance with 5.30 (7)(8) is mandatory and pre-requisite for supply of electricity, this Court disposes of the writ petition with liberty to the petitioner to comply with the requirement applicable to the petitioner under clause 5.30 of the Supply Code, 2018. If the petitioner submits the requisite proof of occupancy/identity, the indemnity having already been submitted, the authority should consider the application and take a final decision expeditiously within four weeks thereafter.
5. The writ petition stands disposed of.
6. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
