1. The writ petitioner claimed to be a contractor who executed the work of construction of a pond on some land in Campbell Bay.

2. A dispute at the instance of a third party arose in the process. The third party objected to the construction of a pond on the site, claiming that it was his land. Under such circumstances, the work was somehow hampered for some time. The Court is informed that now the issue has attained finality by disposal of MAT/44/2025 recently.

3. It is submitted by learned advocate for the writ petitioner that in view of settlement of the dispute raised by the third party, the petitioner is entitled to payment of work executed by him.

4. Learned advocate for the petitioner relied upon the work completion certificate issued by the Junior Engineer of the Construction Division, APWD, Campbell Bay.

5. Learned advocate for the respondents, on the other hand, submits that perusal of the work completion certificate reveals that the work completion certificate was subject to measurement of the works being recorded; and quality being checked by the competent authority.

6. This remaining scrutiny of the completed work therefore lies on part of the respondent authorities. It is submitted by the learned advocate for the respondents that the authorities shall proceed expeditiously for recording measurement and for conducting the quality check within a period of six weeks from date.

7. The writ petition is accordingly disposed of expecting the exercise to be completed within six weeks from date so as to facilitate consequential steps for payment of an amount found due, in accordance with law.

8. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
