1. Learned advocate for the petitioner submits that along with 12 other persons, the writ petitioner is the recorded tenant of the land in question. They are seeking sub-division of the settled land under Regulation 198 of the Andaman and Nicobar Islands Land Revenue and Land Reforms Regulation, 1966.

2. The request jointly made on 07.10.2024 by nine settlers has not been processed by the Deputy Commissioner, South Andaman at Port Blair till date.

3. Learned advocate for the Andaman and Nicobar Administration submits that the writ petition itself reveals that notice was issued upon the 13 persons for whom the sub- division has been claimed by the writ petitioner. She submits, upon instructions, that since they are not appearing and some discrepancies as contained in the letter dated 03.01.2025 issued by the Assistant Commissioner (S), have not been resolved, the matter could not be disposed of.

4. Learned advocate for the writ petitioner submits that there is no dispute between 13 persons in respect of whom the sub-division is claimed. It is submitted that the 13 persons will appear before the Deputy Commissioner on the next date fixed in the matter and submit necessary details for resolving the discrepancies raised in the letter dated 03.01.2025 by the Assistant Commissioner.

5. Considering the rival submissions, this Court disposes of the writ petition enabling the writ petitioner along with 12 others persons in respect of whom the sub-division is claimed in the application, to appear before the Deputy Commissioner, South Andaman in RC No.150/GIS/2024/DC (SA-3) on the next date fixed, to enable the disposal of the matter. Subject to cooperation by the writ petitioner for resolving the discrepancies raised in the letter dated 03.01.2025, the Deputy Commissioner shall dispose of the matter by passing final order dealing with the claims raised by the writ petitioner, in accordance with law.

6. The entire exercise be completed by the Deputy Commissioner, South Andaman within a period of three months from the date of receipt/production of a copy of this order.

7. The Court has not expressed any opinion on the merits of the claim, which shall be considered by the Deputy Commissioner, in accordance with law.

8. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
