ORDER

03.04.2023 Heard Shri Mainuddin Ahmed, Ld. Counsel for the applicant and Shri P.J. Barman, Ld. Counsel for the respondents. This application has been filed seeking correction in order dated 05.09.2022 of this Tribunal by which the case has been ordered to be listed after the decision of the Full Bench. It is submitted by the Ld. Counsel for the applicant that on 05.09.2022 the case was taken up for hearing through Video Conferencing wherein applicant had made a prayer for withdrawal of the case and was of the view that his request has been allowed .and case has been dismissed as withdrawal, whereas, when the order was transcribed and signed by the Bench Members it came to his notice that his case has been ordered to be listed after the decision of the Full Bench in the matter of granting maintenance allowance. He submits that since the applicant does not wish to press the Original Application, rather wants to withdraw the Original Application without any liberty, the order dated 05.09.2022 be modified and Original Application be dismissed as withdrawn. Ld. Counsel for the respondents has no objection in the above submissions. In view of the above, the order dated 05.09.2022 is modified and as prayed by the Ld.
