IN THE GOODS OF: SANJAY SURYA PRAKASH MEHTA ALSO KNOWN AS SANJAY PRAKASH MEHTA (DEC.)
BEFORE: The Hon'ble JUSTICE PARTHA SARATHI CHATTERJEE Date : 6th October, 2026.
Appearance: Mr. Rishabh Karnani, Adv. Mr. Joydeep Guha, Adv. …for the executors
The Court: Supplementary affidavit filed on behalf of the petitioners is taken on record. Mr. Karnani, learned Advocate appearing for the petitioners, submits that all the legal heirs, by filing affidavits, have given their no objection to the grant of probate. He further submits that the affidavits of the attesting witnesses have also been filed. In view thereof, he submits that probate be granted in respect of the Will. This application has been presented for grant of probate in respect of the last Will and Testament dated 3rd January, 2021. In the application, it has been specifically mentioned that the writing is the last Will and Testament of the testator. The time of death has been mentioned, and it has also been stated that, at the time of death, the testator had a permanent place of abode within the territorial jurisdiction of this Court. The affidavits filed by the attesting witnesses specifically aver that the testator had seen the witnesses sign the Will, and similarly, the witnesses had also seen the
2 testator put his signature on the Will. Thereafter, the petitioner complied with the formalities as mentioned in Section 276 of the Indian Succession Act, 1925. The petitioner has proved that the Will was duly executed and attested. Therefore, there cannot be any impediment to the grant of probate. In view thereof, the application is allowed. Let probate be granted upon payment of ad valorem Court fees, if not already paid. PLA/301/2023 is thus disposed of.
