CS-COM/75/2026

DHANANJAI LIFESTYLE LIMITED Vs SANVIE-RETAIL PRIVATE LIMITED AND ORS.

BEFORE: The Hon'ble JUSTICE ANIRUDDHA ROY Date : October 1, 2026.

Appearance: Ms. Ankita Baid, Adv. Mr. Tamoghna Saha, Adv. …for the plaintiff

The Court: Mr. Tamoghna Saha, learned Advocate appearing for the plaintiff submits that there are some formal and procedural defects in the plaint. He further submits that by an order dated August 31, 2026, this Court has allowed amendment in the plaint, as was sought for. Even thereafter, certain further defects have been discovered. In view of the above, learned Advocate for the plaintiff prays for withdrawal of the suit and to file afresh on the self-same cause of action by curing defects. Writ of summons has not yet been served. Accordingly, instant suit CS-COM/75/2026 stands dismissed as withdrawn, with liberty to file afresh before the jurisdictional Civil Court on the self-same cause of action between self-same parties. Court fees already paid shall be returned to the plaintiff and the same can be used while filing the next suit, if any.
