The Court: Learned Counsel for the award-debtor submits that he has succeeded in the appeal preferred under Section 37 of the Arbitration and Conciliation Act, 1996, being AO-COM/62/2025, whereby the Court, vide order dated 14.09.2026, remanded Miscellaneous Arbitration Commercial Case No. 07 of 2022 to the Commercial Court at Siliguri for adjudication on merits. In view of the aforesaid, the present execution petition has become infructuous. Pending applications, if any, stand disposed of. The petitioner is at liberty to institute appropriate proceedings in accordance with law at an appropriate stage.
