IN THE GOODS OF:

MAHESH KUMAR AGARWAL(DEC.)

SHARAD AGARWAL AND ANR.

BEFORE:

THE HON’BLE JUSTICE SABYASACHI BHATTACHARYYA

-AND-

THE HON’BLE JUSTICE SANDIP KUMAR DE

Date: August 19, 2026.

APPEARANCE:

Ms. Amrita Panja Moulick, Adv.

Mr. Satyaki Mukherjee, Adv.

…for the Respondents

The Court:

1. The appellant remains consistently unrepresented, at least on the last three occasions.

2. Learned counsel appearing for the respondents hands over the printout of an e-mail, from which it transpires that an information was given to the learned advocate for the appellant as to the appearance of the respondents.

3. A copy of the memorandum of appeal and the stay petition was also sought. However, it is submitted by learned counsel for the respondents that no such copy has been handed over till date to the learned advocate for the respondents.

4. Since the appellant chooses to remain unrepresented even today, we have no other option but to dismiss the appeal for default.

5. Hence, APO/132/2021 is dismissed for default without any order as to costs.

6. Interim order, if any, stands vacated.

7. The print out of the e-mail handed over in court today be kept on record.
