BEFORE: THE HON’BLE JUSTICE SABYASACHI BHATTACHARYYA -AND- THE HON’BLE JUSTICE SANDIP KUMAR DE Date: 12th August, 2026.
The Court: We find that on two previous occasions, i.e. on September 24, 2025 and December 24, 2025, the matter was adjourned on the prayer of the appellants. Thereafter, on May 13, 2026, May 20, 2026and July 22, 2026, none appeared for either of the parties at the time of call. Thus, it transpires that the appellants are no longer interested to proceed with the appeal. Accordingly, APO/514/2017 along with IA NO: GA/1/2017 (Old No: GA/994/2017) are dismissed for default without any order as to costs. Interim order, if any, stands vacated.
