BEFORE: The Hon’ble JUSTICE ARINDAM MUKHERJEE Date: 16th July, 2026.

Appearance: Mr. Sayantan Bose, Mr. Rajarshi Dutta, Mr. Shounak Mukhopadhyay Ms. Priyanka Gope, Advocates for the plaintiff. Mr. Altamash Alim, Mr. Sumit Biswas, Advocates for defendant no.1.

The Court: It is submitted on behalf of the plaintiff that the issues involved in the suit have been amicably resolved between the plaintiff and the defendant no.1 which is not disputed by the said defendant. Learned Advocate representing the plaintiff places an instruction received through an electronic mail dated 16th July, 2026 from his client which is kept with the records. It is the categorical submission on behalf of the plaintiff that the plaintiff is also not willing to proceed against the other defendants. In the aforesaid facts and circumstances, by consent of the plaintiff and the defendant no.1, the suit is treated as on the day’s list even in the absence of the other defendants since the plaintiff does not wish to proceed against the other defendants. The suit is, accordingly, disposed of recording a settlement between the plaintiff and the defendant no.1 and for non-prosecution against the other defendants. Since the suit itself is disposed of, all applications filed in the suit which are pending are also disposed of without any further order.

Interim order, if any, including appointment of Receiver/Special Officer, if any, in the said applications shall also stand discharged.

(ARINDAM MUKHERJEE, J.)
