14.06.2016 Heard Ms Rita Devi, learned Counsel for the applicant and Brig. N.Deka, learned Central Govt. Standing Counsel, assisted by Maj Dibakar Chandra, OFFG OIC, AFT Cell, appearing for the respondents. Having heard the learned Counsel for the parties and upon perusal of the averments made in the application, we are of the view that since the claim of the applicant in O.A. 13/2016 is for disability pension, the M.A. is required to be disposed of with the observation that in case the applicant is found to be entitled to the disability pension, as claimed in the O.A., the arrear would be restricted to the period of three years preceding the date of filing of the O.A. M.A. is accordingly disposed of.
