Heard Mr. D.Gogoi, learned Counsel for the applicant and Mr. N.Baruah, learned Central Govt. Standing Counsel, assisted by Col Anand, OIC, AFT Legal Cell appearing for the respondents.
2. Learned Counsel appearing for the respondents submits that though this Tribunal vide order dated 17.06.2016 directed production of certain records, while the Army Order, relating to the writing of the ACRs and also the Service Record, apart from the records relating to consideration of non-statutory complaint filed by the applicant are available with him, the relevant records of non-statutory complaint filed by No. 13988659P, however, has not been made available to him. Learned Counsel, therefore, prays for further time to obtain the said records for production before this Tribunal on the next date fixed.
3. Having regard to the contention of the applicant in the O.A., we are of the view that the said records, relating to the consideration of the non-statutory complaint including the relevant noting by the Commanders in chain filed by the applicant as well as No. 13988659P, are required to be perused by the Tribunal and hence the respondents, on the next date fixed, shall produce the same along with the relevant Army Orders relating to the writing of the ACRs and also the Service Record of the applicant.
