ORDER

08.11.2016.

1. Learned legal aid counsel has submitted that since the respondents in their counter affidavit filed has taken up the plea that the application under Section 164(2) of the Army Act, 1950, filed by the applicant has been rejected by the Chief of the Army Staff (in short COAS), the OA needs to be amended by challenging the said order passed by the COAS. Hence the applicant may be permitted to file appropriate application in this regard.

2. Prayer is allowed.

3. List this OA for orders, day after tomorrow i.e. on 10.11.2016 along with the application that may be filed by the learned legal aid counsel.
