ORDER

20.03.2017.

Heard Mr. AR Tahbildar, learned Counsel for the applicant and Brig N.Deka, learned Central Govt. Standing Counsel assisted by Col Anand, OIC, Legal Cell, Guwahati appearing for the respondents.

2. Brig. N.Deka, learned Counsel appearing for the respondents on instruction has submitted that the Second Appeal preferred by the applicant on 5th March, 2016 could not be disposed till date, as the medical records pertaining to the applicant was lost in the Office of the PCDA, Allahabad, which, however, was subsequently reconstructed from the Office copies available on record and the matter is still under consideration by the Second Appellate Committee. Learned Counsel submits that the respondents may be granted time till the end of June, 2017 to consider and dispose of the said Second Appeal.

3. It appears that the Second Appeal filed by the applicant is pending for more than one year, may be, for the reason that the original medical papers were earlier lost and such medical records are constructed on the basis of the office copies available on record. There is no impediment now to dispose of the second appeal.

4. Hence, we direct the second appellate authority to decide the same by a speaking order by 20th May, 2017, and produce a copy of the order that may be passed on the next date fixed.

5. List on 24th May, 2017.

6. Order dasti.
