ORDER

24.10.2017.

Dr. G.Lal, learned Counsel appearing for the applicant, is stated to have expired. Ms U.Zeeham, learned Proxy Counsel, who put in appearance, has stated that the applicant has taken the file back from them and hence they do not have any instruction in the matter.

2. Perusal of the office note shows that although the matter has been adjourned on earlier occasions also to enable the applicant to file appropriate application before the Principal Bench for transfer of the matter to a Bench of which Hon`ble Mr. Justice B.P.Katakey is not a Member and despite expiry of one and half year no such application has been filed by the applicant. It seems that the applicant is not interested in the proceeding.

3. The application is accordingly dismissed for non-prosecution.
