1. Heard Mrs.Rita Devi, learned counsel appearing for the applicant and Brig N.Deka(Retd), learned CGSC assisted by Capt. Akash Vashishta, OIC,AFT, Legal Cell, appearing for the respondents.
2. By filing this OA, the applicant has challenged the impugned order dated 08.09.2018 passed by the Col A(D&V) on behalf of GOC-in-C, Headquarters Eastern Command, directing deduction of 25% of applicant’s pay and allowances for maintenance of his children.
3. The applicant has also prayed for an interim order on stay of the impugned order.
4. Admittedly the children are in the custody of their mother. Therefore, we are not inclined to pass any interim order at this stage.
5. Respondents are directed to file their counter within two weeks.
6. List the matter in the month of January,2019 whenever this Division Bench reassembles.
