1. By filing this application under section 22 (c) of AFT Act, the applicant has prayed for condonation of delay of 01 year 09 months 20 days in filing the Original Application. It appears from the application that the applicant, who was convicted in General Court Martial, approached the High Court as well as Hon’ble Supreme Court for redressal of his grievances and therefore there was delay in filing the OA.

2. Mr.P.K.Garodia, Learned CGSC, assisted by Capt. Nisha Thomas, OIC, AFT Cell, appearing for the respondents has conceded that the respondents have no objection if delay is condoned.
3. Considering the grounds mentioned in the application, we are inclined to condone the delay.
4. Acordingly, the delay in filing the Original Application is hereby condoned and this Misc.Application has been disposed of.
