1. This Cr.M.P. has been preferred for grant of leave to the appeal.
2. Heard on I.A. No. 01/2026, application for condonation of delay on behalf of the appellant (State).
3. On due consideration, the same is allowed and the delay in preferring the instant petition is hereby condoned.
4. Counsel for the Appellant/ State would submit that the trial Court in paragraph-25 of the judgment has recorded its finding that the victim was below 18 years, still has acquitted the accused on the ground that

there is delay in lodging the FIR without ascertaining whether the delay in such situation is fatal or not.
5. The petition being arguable is admitted for hearing.
6. Registry is directed to register the present Cr.M.P. under the head of “Acquittal Appeal”.
7. Let bailable warrant be issued against the Respondent for a sum of Rs. 5,000/- through concerned Superintendent of Police for their appearance before this Court on 14.01.2027.
8. In view of the above, the present Cr.M.P. stands disposed of.
