Order on Board
16/10/2026
1. Heard on I.A.No.1/26, application for condonation of delay in filing the MCC.
2. Upon due consideration of the application, the same is allowed. Delay in filing MCC is condoned.
3. This MCC has been filed for restoration of MAC No.123/2024 which was dismissed on account of peremptory order passed by this Court on 27/04/2026.
4. Learned counsel for the applicant submits that this Court while issuing fresh notice to respondent No.5 directed payment of P.F. within 7 working days failing which the appeal would stand dismissed without reference to the Bench. He submits that due to communication gap between the applicant and the office of the counsel, compliance of the order could not be effected and as a result, the appeal came to be treated as dismissed. He submits that the mistake is bonafide and not deliberate and prays that the MCC may be allowed and MAC No.123/2024 may be restored.
5. Taking into consideration the reasons assigned in the application, the MCC is allowed. MAC No.123/2024 is restored to its original number. Sd/-
