1. Heard on admission.

2. This Criminal Revision under Section 19(4) of the Family Courts Act, 1984, has been filed challenging the order dated 14.08.2026 passed by the learned First Additional Principal Judge, Family Court, Raipur, in Misc. Criminal Case No.119/2026, whereby the learned Family Court has directed the petitioner/ son to pay a sum of Rs.10,000/- per month to the respondent/mother towards interim maintenance.

3. Learned counsel for the applicant submits that, though the respondent is the mother of the applicant, but she is receiving a family pension of Rs.12,500/- per month. He further submits that, without any sufficient reason and on her own wish, the respondent/mother has left the company of the applicant and AJAY KUMAR DWIVEDI cn=AJAY KUMAR DWIVEDI, ou=HIGH COURT, o=HIGH COURT OF CHHATTISGARH, st=Chhattisgarh, c=IN

is residing with her daughter. He also submits that, though the applicant is presently working as a Cashier in the Central Bank of India, Gondia Branch, Maharashtra, and is earning a gross salary of approximately Rs.1,54,000/- per month and a net salary of about Rs.95,000/- per month, but he has availed an education loan and is paying substantial monthly installments towards the same. He also has various other family liabilities. Therefore, it is prayed that the order directing payment of interim maintenance be set aside.

4. During the course of arguments, learned counsel for the applicant fairly apprised the Court that the applicant is the only son of the respondent/ mother. It has not been disputed that his gross salary is approximately Rs.1,54,000/- per month and his net salary is about Rs.95,000/- per month. However, despite the aforesaid income, the applicant has expressed his pain and inability to pay interim maintenance of Rs.10,000/- per month to his old aged mother. Whereas, looking to the cost of living in the society, earning of the applicant, the amount of Rs.10,000/- per month towards her maintenance cannot, by any stretch of imagination, be said to be excessive. Moreover, merely because the applicant has availed a loan and has other financial liabilities, he cannot escape from his legal and moral obligation to maintain his old aged mother.

5. Accordingly, this Revision is dismissed in limine.

6. Pending application(s), if any, stand disposed of. Sd/- (Naresh Kumar Chandravanshi) Judge Ajay
