Order

on Board

15.10.2026

1. By filing the present petition, the petitioner assails the notice dated 05.10.2021 issued by the respondent authorities initiating an enquiry into his caste certificate, contending that the same issue had already been enquired into by the competent authority. The petitioner has prayed for following relief(s) :- “(1) That, the re-initiation of the enquiry regarding the caste certificate of the petitioner may kindly be stopped by quashing notice annexure P-1.

(2) That, the respondent no. 3 may kindly be directed to immediately stop the enquiry by considering previous enquiry and enquiry report of same authority.

(3) That, any other relief may kindly be passed in the favour of the petitioner as the Hon'ble Court thinks fit and proper in his favour.”

2. Learned counsel for the petitioner submits that, by efflux of time, the present petition has become infructuous, as the petitioner has already retired from service on 30.06.2022. He further submits that the challenge in the present petition is confined to the notice initiating the enquiry and that no further proceedings have been initiated by the authorities pursuant thereto. He also submits that, in view of the interim order passed by this Court staying the enquiry, no further enquiry could be conducted. Since the petitioner has already retired from service, no further adjudication in the matter is required.

3. Learned State counsel submits that the petitioner has retired from service on 30.06.2022.

4. Having heard learned counsel for the parties and considering the fact that the petitioner has already retired from service on 30.06.2022, nothing further survives for adjudication in the present petition.

5. Accordingly, the writ petition is disposed of as having become infructuous.
