1) The applicants have preferred this First Bail Application under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, they have been arrested in connection with Crime No.67/2026 registered at Police Station- Singhoda, District Mahasamund (C.G.) for the offence under Sections 331(4), 305, 317 & 3(5) of BNS.

2) As per the prosecution case, Harish Chandra Patel lodged an FIR alleging that an amount of Rs.10,000/- in cash, two gold earrings, three gold rings and silver ornaments had been stolen from his house.

On the basis of said complaint, the police registered the offence, as stated above, against the present applicants.

3) Learned counsel for the applicants would submit that the present applicants have falsely been implicated in this case. He would further submit that the applicants, along with five other accused persons, were arrested on suspicion on 07.07.2026. He would contend that no stolen articles were seized from the possession of the applicants. He would further contend that the applicants have no criminal antecedents, the charge-sheet has already been filed, they are in jail since 07.07.2026, and the conclusion of the trial is likely to take a considerable amount of time. Therefore, he prays for grant of regular bail to the applicants.

4) On the other hand, learned State counsel opposes the bail applications and submits that the applicants sold the stolen articles to someone else and, therefore, they are involved in the crime. She further submits that a prima facie case is made out against the applicants and thus, the bail application of the applicants deserves to be rejected.

5) I have heard learned counsel appearing for the parties and perused the case diary.

6) Taking into consideration that no stolen article was recovered from the possession of the applicants; they have no criminal antecedents; the charge-sheet has been filed before the competent Court; the applicants are in jail since 07.07.2026; and the trial may take some more time to conclude, this Court is of the view that the applicants are entitled to be released on bail. Accordingly, the bail applications are allowed.

7) It is directed that in the event of the applicants executing a personal bond for a sum of Rs.50,000/- each with one surety in the like sum to the satisfaction of the concerned trial Court, they shall be released on bail on the following conditions:-

(i) they shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such fact to the Court;

(ii) they shall not act in any manner which will be prejudicial to fair and expeditious trial, &

(iii) they shall appear before the trial Court on each and every date given to them by the said Court till disposal of the trial. The observation made hereinabove is for the purpose of deciding this bail applications only, the learned trial Court shall decide the case on its own merits. Sd/- (Rakesh Mohan Pandey) JUDGE Rekha
