Hon’ble Shri Justice Rakesh Mohan Pandey Order on Board 15/10/2026

1. This is the first bail application filed under under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicants, who have been arrested in connection with Crime No.336 of 2026 registered at Police Station Mulmula, District Janjgir- NIRMALA RAO

Champa, Chhattisgarh for the offence punishable under Sections 331(4), 305(a) & 3(5) of BNS.

2. As per the prosecution case, the applicants, along with other co- accused, committed theft of DJ equipment, including a sound box, an amplifier, one domestic HP gas cylinder, etc., worth Rs.1,40,000/- from the complainant's house on 21.08.2026. An FIR was lodged, and during the course of investigation, the applicants and other co-accused were taken into custody, and the stolen articles were recovered at their instance.

3. Learned counsel appearing for the applicants would submit that the applicants are innocent and have falsely been implicated in the present case. They would contend that the charge-sheet has already been filed and that the applicants have been in jail since 25.08.2026. It is further submitted that applicant No.2, Sandeep Tiwari, has one criminal antecedent registered in the year 2025 under Sections 296, 351(3), 115(2) & 119(1)(5) of the BNS, whereas applicants No.1 and 3 have no criminal antecedents. They would, therefore, pray for grant of bail to the applicants.

4. On the other hand, learned Government Advocate and Panel Lawyer appearing for the non-applicant would oppose the bail application. They would submit that applicant No.2 has one criminal antecedent and these applicants have committed theft at the complainant's house, and that the stolen articles were recovered from their exclusive possession. They would, therefore, submit that the bail application deserves to be rejected.

5. I have heard learned counsel for the parties and perused the case diary.

6. Having considered the fact that a case under Sections 296, 351(3), 115(2), 119(1) and 5 of the BNS was registered against applicant No.2, Sandeep Tiwari, in the year 2025, whereas applicants No.1 and 3, Neeraj Kumar Patle and Amar Tandan, have no criminal antecedents of a similar nature; that the charge-sheet has already been filed; that the applicants have been in jail since 25.08.2026; and that the conclusion of the trial is likely to take some time, this Court, without commenting on the merits of the case, is inclined to grant regular bail to the applicants. Accordingly, the bail application is allowed.

7. It is directed that in the event of the applicants executing a personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the concerned Trial Court, they shall be released on bail, on following conditions :- I. They shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such fact to the Court;

II. They shall not act in any manner which will be prejudicial to a fair and expeditious trial;

III. They shall appear before the trial Court on each and every date given to them by the said Court till the disposal of the trial; and,

IV. They shall not involve themselves in any offence of a similar nature in future.

The observation made in the course of this order is only for considering the case of the applicants on the applications for the grant of regular bail. The concerned trial Court shall not be influenced or bound by any observation made in the course of this order. Sd/-
