1. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 699/2026, registered at Police Station – Kotwali (Police Outpost – Manipur), District – Korba (C.G.), for offences punishable under Sections 331(4), 305(1), and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

2. The case of the prosecution, in brief, is that the complainant, Laxmi Das, who is employed as a daily wage peon at Minimata Girls College, Korba, lodged a report alleging that in the intervening night of 22nd and 23rd August, 2026, some unknown persons committed house-trespass into the college premises and committed theft of three aluminum window frames valued at approximately 21,000/-. On the basis of the said ₹

report, an FIR was registered against unknown persons. During the course of the investigation, the applicant was arrested and the stolen articles are alleged to have been recovered from his possession.

3. Learned counsel for the applicant submits that the applicant is innocent and has falsely been implicated in the crime. It is further submitted that the applicant has no criminal antecedents; the investigation has been completed and the charge-sheet has already been submitted before the competent court; the applicant has been languishing in jail since 30.08.2026 and trial is likely to take considerable time to conclude; thus, it is prayed that the applicant may be enlarged on regular bail.

4. On the other hand, learned State counsel opposes the bail application and submitted that the stolen articles were recovered from the possession of the applicant, and as such, a prima facie case is made out against him; hence, he is not entitled to be released on bail.

5. I have heard learned counsel appearing for the parties and perused the case diary.

6. Taking into consideration the nature and gravity of the allegations; the fact that the applicant has no criminal antecedents; the charge-sheet has already been filed; the applicant has been in judicial custody since 30.08.2026; and the final conclusion of the trial will take time, without commenting on the merits of the case, this Court is inclined to release the applicant on regular bail. Accordingly, the application for grant of regular bail is allowed.

7. It is directed that in the event of the applicant executing a personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, he shall be released on bail, on following conditions :-

(i) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court,

(ii) he shall not act in any manner which will be prejudicial to fair and expeditious trial, and

(iii) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.

8. The observation made hereinabove is for the purpose of deciding this bail application only, the trial Court shall decide the case on its own merits. Sd/-
