Hon’ble Shri Justice Rakesh Mohan Pandey Order on Board 15/10/2026

The applicant has preferred this first bail application under Section 483 of Bharatiya Nagrik Suraksha Sanhita, 2023 as he is in jail since 11.06.2025 in connection with Crime No. 41/2025 registered in Police Station – Sukma, District Sukma (CG) for commission of offence punishable under Section 20(B)(ii)(C) of NDPS Act, 1985.
2. Case of the prosecution, in brief, is that the Police of Police Station Sukma, District Sukma (C.G.) seized 5.450 Kgs of contraband article i.e. Ganja from the possession of present applicant, thereafter, aforesaid offence has been registered against the applicant.

criminal antecedent in which he has already been acquitted. He would submit that charge-sheet has already been filed and the applicant is in jail from 11.06.2025. Thus, he would pray for grant of bail.
4. On the other hand, learned Government Advocate appearing for the State/non-applicant would contend that the police after getting secret information, seized total 24.600 Kgs of Ganja from the possession of the applicant and other 04 co-accused. He would submit that recovered quantity of Ganja is of above commercial quantity, therefore, the stringent condition contained in Section 37 of NDPS would attract in the present case. It is also contended that bail applications of 03 co- accused have already been rejected by the High Court in MCRC No. 8642/2025, MCRC No. 2637/2026 and 7933/2026, even SLP filed by another co-accused was also dismissed by the Hon’ble Supreme Court
5. I have heard learned counsel for the parties and perused the case diary.
6. Having considered the fact that total 24.600 Kgs of Ganja was seized from the possession of the applicant and other co-accused, the bail applications of other co-accused have already been rejected, even SLP preferred by the one of the co-accused has already been dismissed by the Hon’ble Supreme Court and further taking into consideration the stringent condition contained in Section 37 of NDPS would attract in the present case, therefore, I am not inclined to release the applicant on regular bail. Accordingly, the instant bail application of the applicant is rejected. Sd/-
