1) The applicant has preferred this First Bail Application under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, he has been arrested in connection with Crime No.153/2026 registered at Police Station Pachpedi, District Bilaspur (C.G.) for the offence under Sections 305, 331(4), 3(5) of BNS.

2) The prosecution case, in brief, is that Roshan Dhariya lodged an FIR on 28.05.2026, stating that on 27.05.2026, while he was sleeping with his wife and children, an unknown person committed theft of five nose pins, one mobile phone, and cash amounting to Rs.40,000/-.

Accordingly, an FIR was registered against an unknown person. During the course of investigation, the police arrested the applicant and, at his instance, seized a mobile phone and a nose pin. Hence the bail application.

3) Learned counsel for the applicant submits that the applicant is innocent and has falsely been implicated in the present case. He further submits that the charge-sheet has already been filed, the applicant is in jail since 03.06.2026, and he has only one criminal antecedent, registered under the Arms Act in the year 2024, thus, he would pray for grant of bail to the present applicant.

4) On the other hand, learned State counsel opposes the bail application and submits that the charge-sheet has already been filed before the competent Court. She further submits that some of the stolen articles were recovered from the conscious possession of the applicant and he has one criminal antecedent. Therefore, she prays for rejection of the bail application.

5) I have heard learned counsel appearing for the parties and perused the case diary.

6) Having considered the facts and circumstances of the case, particularly the alleged offence relates to theft; the stolen articles, including a mobile phone and a nose pin, have been seized at the instance of the applicant; the charge-sheet has already been filed; the applicant is in jail since 03.06.2026; and he has only one criminal antecedent, registered under the Arms Act in the year 2024, without commenting on the merits of the case, this Court is of the view that the applicant is entitled to be released on bail. Accordingly, the bail application is allowed.

7) It is directed that in the event of the applicant executing a personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, he shall be released on bail on the following conditions:-

(i) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court;

(ii) he shall not act in any manner which will be prejudicial to fair and expeditious trial, &

(iii) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
