1. This is the first bail application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of anticipatory bail to the applicant who is apprehending his arrest in connection with Crime No. 493/2026 registered at Police Station - Newai, District – Durg (C.G.) under Sections 420 of the Indian Penal Code.

2. As per the prosecution case, on 21.07.2026, complainant Hemlata Dhruw lodged a written complaint alleging that present applicant, being known to her and belonging to the same community, induced her to invest ₹1,00,000/- in a business operating under the name and style of “My Victory Club,” promising returns up to three times the invested BALRAM PRASAD DEWANGAN Digitally signed by BALRAM PRASAD DEWANGAN

amount. Accordingly, on 25.01.2023, complainant paid ₹1,00,000/- in cash to applicant, who assured her of regular updates on her mobile phone. However, after six months, when she demanded the return of her money, applicant failed to provide a satisfactory response and did not return the amount.

He submits that husband of complainant was Advocate of applicant in the proceeding registered against applicant under Section 125 of Cr.P.C. and Section 498-A of I.P.C. During that period applicant has given his signed papers to be used in proceedings and it appears that one of those papers have been misused. There is no other criminal antecedents against applicant. Hence, it is prayed that applicant may be extended the benefit of anticipatory bail.

4. Learned State counsel opposes the submission of learned counsel for applicant. He submits that as per allegation, applicant has procured Rs.1,00,000/- for investment in My Victory Club business, however, it was not returned. There is undertaking given by applicant, which bears the signature of applicant. However, he do not dispute the submission of learned counsel for applicant that there is no criminal antecedents.

respective parties, without commenting anything on merits of the case, I am inclined to release the applicant on anticipatory bail.
