1. This MCC has been filed for restoration of Contempt Case (C) No. 803 of 2025, which came to be dismissed for want of prosecution vide order dated 04.08.2026.

2. Learned counsel for the applicant submits that the aforesaid contempt case was listed for hearing on

04.08.2026. However, none appeared on behalf of the applicant, nor was any representation made to press the contempt petition despite repeated calls. Consequently, the contempt petition came to be dismissed for want of prosecution.

3. It is further submitted that the applicant is desirous of pursuing the matter and tenders an apology before this Court for the aforesaid lapse, with an undertaking not to repeat such a mistake in future. Learned counsel, therefore, prays that the order dated 04.08.2026 be recalled and Contempt Case (C) No. 803 of 2025 be restored to its original number.

4. I have heard learned counsel for the applicant and perused the material available on record.

5. Considering the facts and circumstances of the case, the explanation furnished by the applicant and the fact that the applicant is desirous of pursuing the contempt petition on merits, this Court is of the view that an opportunity deserves to be granted to the applicant in the interest of justice. The non-appearance appears to be inadvertent, and the applicant has tendered an apology for the same.

6. The order dated 04.08.2026, whereby Contempt Case (C) No. 803 of 2025 was dismissed for want of prosecution, shall stand recalled, and Contempt Case (C) No. 803 of 2025 shall be restored to its original number.
